Find It, Rent It OR Buy It — Terms of Service

1. Introduction

These Terms of Service ("Terms") govern the access to and use of the Find It, Rent It OR Buy It property marketplace ("Platform"), operated by Find It, Rent It OR Buy It ("we", "our", or "us").

By registering for, accessing, or using the Platform, you ("User", "Advertiser", "Agent", "Landlord", "Seeker", "Tenant", or "Buyer") agree to be bound by these Terms. If you do not agree with these Terms, you must not access or use the Platform.

2. Definitions

For purposes of these Terms:

Platform means the Find It, Rent It OR Buy It web and mobile applications, back-office tools, and related property listing, discovery, marketing, viewing, booking, escrow, messaging, review, and analytics services.

Listing means any property, room, unit, or space published on the Platform for rent, sale, or short-let.

Advertiser means any landlord, owner, agent, agency, or authorised representative who posts a Listing.

Seeker means any prospective tenant, buyer, or short-let guest who uses the Platform to discover Listings.

Credits means the prepaid units used to promote, publish, or unlock certain paid features on the Platform.

Marketplace Services means Listing visibility, promoted placements, contact unlocks, verification badges, escrow, market reports, and any other paid or free feature made available by us.

3. Nature of Service

The Platform is provided as a Software-as-a-Service (SaaS) marketplace that connects Advertisers and Seekers. We are not a party to any rental, sale, or short-let transaction concluded between users.

The Platform may include:

• Property listings (rent, sale, short-let)
• Search, discovery, and map-based browsing
• Suburb intelligence and market reports
• Viewing bookings and short-let bookings
• In-platform messaging and inquiries
• Deposit escrow facilities
• Advertiser CRM and team workspaces
• Verification and trust services
• Reviews and ratings
• Promotional and featured placements
• AI-assisted listing drafting and voice dictation
• Integrations with third-party payment, messaging, and identity providers
• Future features introduced by us

We may modify, improve, replace, or discontinue features without prior notice.

4. Accounts and Eligibility

4.1 Registration

Users must provide accurate, current, and complete information when creating an account, and keep such information up to date.

4.2 Eligibility

Users must be at least 18 years old and capable of entering into a binding contract. Business users must be duly registered and authorised to transact on behalf of the entity they represent.

4.3 Account Security

Users are responsible for all activity under their account and must keep credentials confidential.

5. Listings and Advertiser Obligations

Advertisers warrant that they:

• Own the property or have the owner's authority to advertise it.
• Hold any mandate, agency, or estate agent registration required by law.
• Provide accurate descriptions, prices, availability, photos, and contact details.
• Do not duplicate Listings for the same property across multiple accounts.
• Do not publish discriminatory, misleading, or unlawful content.
• Remove or update Listings promptly when a property is let, sold, or withdrawn.

We reserve the right, at our sole discretion, to review, reject, edit, unpublish, or permanently remove any Listing at any status — including approved, pending, rejected, draft, or expired — where a Listing breaches these Terms, appears fraudulent, is duplicative, receives credible complaints, or otherwise fails to meet Platform standards. No refund of Credits or fees is due where a Listing is removed for breach.

6. Fees, Credits, and Payments

6.1 Fees

Certain features may require payment, including:

• Listing fees
• Featured or promoted placements
• Contact unlock fees
• Verification fees
• Escrow service fees
• Market report and lead-generation fees
• Subscription or credit pack purchases

6.2 Credits

Credits are prepaid, non-refundable, non-transferable, and have no cash value. Credits may expire in accordance with the terms displayed at the time of purchase. Credits do not bear interest.

6.3 Payment Failure

Failure to pay may result in suspension of paid features, removal of promoted placements, unpublishing of Listings, or permanent account deactivation, without liability to us.

6.4 Price Changes

We may revise fees, credit pricing, or feature entitlements at any time upon reasonable notice. Continued use constitutes acceptance.

7. Escrow and Deposits

Where the Platform facilitates a deposit escrow between an Advertiser and Seeker, we act as a neutral facilitator only. Funds are held according to the escrow terms disclosed at the time of the transaction. We do not guarantee the underlying tenancy, sale, or short-let agreement and are not responsible for disputes between the parties, save for administering the escrow in accordance with its stated rules.

8. Short-Let Bookings and Viewings

Bookings and viewings scheduled through the Platform are agreements between the Advertiser and Seeker. Cancellation, refund, and access terms are set by the Advertiser or the specific booking flow. We are not the host, letting agent, or seller.

9. Reviews and Ratings

Users may post reviews and ratings that are truthful, based on genuine experience, and free from unlawful, defamatory, or offensive content. We may moderate, edit, or remove reviews that breach these Terms or our Acceptable Use Policy.

10. AI Features Disclaimer

The Platform may provide AI-generated content such as:

• Listing drafts and descriptions
• Voice-dictated content
• Price insights and recommendations
• Suburb intelligence and market reports
• Duplicate detection and moderation signals

Such outputs are informational only. We do not guarantee accuracy, completeness, or fitness for any particular purpose. Users must independently verify all information — including prices, availability, and legal or tax implications — before acting upon it.

11. User Conduct

Users shall not:

• Use the Platform unlawfully.
• Attempt unauthorized access or scrape data.
• Reverse engineer or copy the software.
• Introduce malware or interfere with operations.
• Circumvent payment, credit, or verification controls.
• Share login credentials without authorization.
• Resell access to the Platform or its data.
• Contact users off-platform to evade fees, unlocks, or safety measures.

Violations may result in immediate suspension or termination.

12. Data Ownership

Users retain ownership of the content they submit, subject to a worldwide, royalty-free, non-exclusive licence granted to us to host, display, translate, index, promote, and otherwise use such content for the purpose of operating and marketing the Platform.

We retain ownership of all software, source code, databases, designs, trademarks, AI models, algorithms, documentation, and Platform architecture. Nothing in these Terms transfers our intellectual property to any User.

13. Data Processing and Privacy

Our collection and use of personal data is described in the Privacy Policy, which forms part of these Terms.

14. Data Backups and Recovery

We may perform routine backups, but backups and restorations are not guaranteed. Users should retain independent copies of any critical information.

15. Service Availability

We aim for high availability but do not guarantee uninterrupted access. Services may be affected by internet outages, hosting failures, cyber incidents, third-party failures, maintenance, or force majeure. We shall not be liable for losses arising from downtime.

16. Third-Party Services

The Platform may integrate with payment gateways (including Paynow), SMS providers, WhatsApp, email providers, mapping and geolocation providers, identity verification providers, cloud hosting, and AI providers. We are not responsible for failures caused by third-party providers.

17. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for loss of profits, business, customers, goodwill, opportunities, data, rental income, sale proceeds, or any indirect or consequential damages, whether arising from contract, negligence, tort, or otherwise.

Our total aggregate liability shall never exceed the amount paid by the User to us in the three (3) months immediately preceding the event giving rise to the claim.

18. Indemnity

Users agree to indemnify and hold us harmless against claims arising from user misconduct, inaccurate Listings, marketplace transactions, regulatory breaches, tax disputes, tenancy or sale disputes, or intellectual property violations committed by the User.

19. Confidentiality

Both parties agree to maintain confidentiality regarding non-public business, financial, and technical information, except where disclosure is required by law.

20. Intellectual Property

All intellectual property rights in the Platform remain our exclusive property. Users may not copy, modify, decompile, distribute, republish, or create derivative works without our written consent.

21. Termination

We may suspend or terminate access immediately where fees remain unpaid, fraud is suspected, security risks exist, illegal activity is detected, or these Terms are breached. Termination does not relieve any User of outstanding payment obligations.

22. Force Majeure

We shall not be liable for failure to perform obligations resulting from events beyond our reasonable control, including natural disasters, war, civil unrest, government action, telecommunications failures, cyberattacks, or power outages.

23. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of Zimbabwe. Any dispute shall first be referred to mediation. Where mediation fails, disputes shall be submitted to the courts of Zimbabwe, which shall have exclusive jurisdiction.

24. Amendments

We may amend these Terms from time to time. Updated Terms become effective upon publication on the Platform. Continued use constitutes acceptance of the revised Terms.
